Patchwork Shepherds Guarantee and Spay / Neuter Contract
This agreement made this _X_ day of _X_, _X_ , between Kimberly Lantz d/b/a Patchwork Shepherds, hereinafter referred to as Seller, and ________________X________________ hereinafter known as Buyer.

SECTION II. HEALTH The purchase price shall include the following vaccinations: Puppy Shot__x___ Puppy Booster__x___ First Adult_____ Second Adult_____ A separate health record with dates will be furnished. Now: ___x__ Later: _____ Buyer acknowledges that this dog is in a healthy condition. Seller has no control over this dog’s environment after acceptance by Buyer and therefore does not guarantee continued good health. Buyer agrees to have the dog examined by a licensed veterinarian within 72 hours of acceptance to certify such health, thereby relieving Seller of any claims. Seller is not responsible for the Buyer’s vet expenses. The seller does not cover Giardia, coccidia, umbilical hernias or any non-life threatening conditions that puppies often have just due to immune systems and changes in homes. Changes and stress can cause flair ups in puppies. The seller guarantees against moderate or severe hip dysplasia (HD) for 36 months based on an Orthopedic Foundation for Animals (OFA) certificate. No guarantee if the cause is accidental or brought on by owner negligence.

SECTION III. CARE
The Buyer promises to provide responsible care for this dog/puppy by providing proper nutrition, sanitary facilities, annual vaccinations and regular veterinary attention including protection from hazards such as traffic, other animals, etc. The dog/puppy will be kept indoors unless a safe outdoor enclosure is provided.
SECTION IV. SPAY/NEUTER
The buyer agrees that this canine will not be used for breeding and will be spayed or neutered by 18 months of age unless otherwise agreed upon and noted in contract. No guarantee will be made for any puppies/dogs that did not get fixed by agreed upon date.
SECTION V. RESALE-REPOSSESSION
The Buyer agrees to notify Seller if he/she cannot or will not care for said dog/puppy any further. Said dog/puppy is to be returned to Patchwork Shepherds with NO REFUND given. Under NO circumstances is the dog/puppy to go to a new home without Patchwork Shepherds being notified and agreeing to it. If shipping is required to return the canine, Patchwork Shepherds will help make shipping arrangements at the buyer’s expense. The dog may be given away if it is to a family relative and IF the Buyer and Seller (Patchwork Shepherds) agree that this is in the canine’s best interest. Under no circumstances will this canine be sold, leased, or given to any pet shop, research laboratory, or similar facility. This contract/guarantee will not be honored if Patchwork Shepherds has not been notified and agreed to new ownership. Seller reserves the right to repossess this canine in the event the Buyer fails or refuses to comply with any or all of the terms of this agreement. The Buyer will bear cost of enforcing compliance.
SECTION VI. ENTIRE AGREEMENT
This agreement supersedes all others, either oral or in writing between the parties concerning the purchase and sale of the above-described canine and contains all of the covenants and understandings between the parties concerning said subject. Any modification or change to this agreement must be agreed upon in writing by both Buyer and Seller.
SECTION VII. SEVERABILITY
If any portion of this agreement is declared invalid, any remaining portion shall remain in force and effect as if it had been executed with the invalid portion eliminated. It is the intention of the parties that they would have executed this agreement without including any such portion, which may, for any reason be declared invalid.

SECTION VIII. GOVERNING LAW
It is agreed by the Buyer and Seller that this agreement shall be deemed to have made and to be perform in the County and state that the seller resides in, and shall be governed by and resolved on accordance with the laws of that county and state.
SECTION IX. ATTORNEY FEES
In the event either the Buyer or Seller shall bring any action in connection with this agreement, the prevailing party shall be entitled to recover as part of such action reasonable attorney fees and cost. We have selectively bred our puppies with the expectation that they will live long and healthy lives. Should your dog experience any serious health problems or accidents, we would greatly appreciate being promptly advised of the situation and its resolution.
